Supreme Court Decides Judulang v. Holder

In a unanimous decision the Supreme Court has reversed judgment of the Ninth Circuit, and remanded the case for further proceedings consistent with the Court’s opinion.  Writing for the Court, Associate Justice Kagan commented, “We must reverse an agency policy when we cannot discern a reason for it.” Criticizing the Board of Immigration Appeals (BIA),  Justice Kagan stated its actions involving petitioner Judulang, “cannot pass muster under ordinary principles of administrative law.”
